Puppy Purchase Agreement

For the purchase of the following puppy:

The above said puppy is being sold for the total price of $__ _. A deposit in the amount of $_ ___ is hereby made and the cash balance is due to seller before this dog is placed in the buyers possession. The buyer(s) understand that once a deposit is made, it is a commitment to buy said dog and is therefore NON-REFUNDABLE. Buyer (s) will forfeit deposit and said dog may then be re-sold if not paid in full by__ ___.
IT IS HEREBY AGREED BY BOTH PARTIES THAT THE FOLLOWING CONDITIONS WILL BE MET AND THAT NO OTHER WARRANTIES OR CONDITIONS ARE EXPRESSED OR IMPLIED.
Buyer(s) certify that he/she is not acting as an agent for another individual in the purchase of this dog and will not sell this dog to any mass-producing kennel or use it in any experiments, laboratory or otherwise or to use it as breeding stock for a puppy mill. Nor is it to be used or trained for activities which are illegal or for which it is not suited by reason of temperament or conformation. Specifically it will not be used as a guard or attack dog or to hunt or fight other animals.
The Buyer agrees to maintain the puppy in a humane environment and properly train and care (quality food, water, shelter and veterinarian care) for the entire life of the dog. The dog will not be allowed to roam or stay as an outside dog 100% of the time, and will be socialized and obedience trained appropriately. The dog will be properly licensed and inoculated against rabies, distemper, parvovirus, and other communicable diseases as recommended by a qualified veterinarian. In order for the guarantee to remain in effect you must keep receipts and records to verify you have regularly taken your pup to a duly licensed veterinarian for checkups and all required immunizations. If buyer fails to do so any/all guarantees are null and void with no reimbursement to buyer.
The Buyer agrees that this puppy will not be raised on slippery surfaces, not be allowed to jump up and down stairs, rough-house with larger dogs, jump down from heights or out of cars, etc., as this type of activity will contribute to the breakdown of joints and growing bones, dislocation of shoulders, hips and damaged elbows.
The Buyer further agrees that the puppy's weight will be under strict supervision until the dog reaches his/her second birthday. It is better to have the dog slightly underweight then overweight as excess weight contributes to structural breakdown of the dog. Buyer also agrees nothing will be given to the dog that would encourage rapid growth including steroids, nutritional supplements and anything that promotes rapid weight gain.
At the expense of the buyer(s), this dog should be examined by a licensed veterinarian within 72 hours of possession. Should this dog be found in ill health, the cause of which is clearly attributable to the breeder, a statement in writing must be provided by that veterinarian documenting said condition for Breeders' veterinarian to review within 24 hrs. Failure to do so would be a breach of contract and null and void this agreement. Upon confirmation from Breeders' vet of said condition, Buyer may return the puppy, registration and all of his/her effects to the Breeder and receive another dog of equal value and quality, the choice to be determined by the sellers. Health guarantee is only valid until the puppy reaches one year from the date of birth. We do not cover your expenses. After the dog leaves our home, the buyer is responsible for all vet bills: including but not limited to, physicals, vaccinations, medications, blood test, x-rays, ultra sounds, necropsies, boarding etc. We do not cover your veterinary expenses . ______(Initial)
If puppy is purchased under a limited registration he/she must be spayed or neutered by the age of 6 months unless noted otherwise. Failure to do so is breach of contract and nulls/voids health guarantee.
We do not guarantee against common ailments such as but not limited to Kennel cough, Giardia, Coccidiosis, Parasite, Ear mites, Fleas, Ticks, Demodex/Mange, Cherry eye, Testicular abnormalities etc.. These and other ailments can be contracted during or shortly after exposure, shipping , environment and stress. Nor any known common defects of the French Bulldog breed such as soft pallet, allergies, small or collapsed nostrils, uneven bite, loose hips and or knees, umbilical, inguinal hernias, etc. Buyer agrees they have educated themselves on the health conditions and problems associated with this breed . ________(initial)
All precautions have been made to insure that this puppy is in excellent health at the time of purchase. Buyer needs to be aware that a puppy is a baby and that sometimes he/she may get sick due to stress or other related reasons. She/he is leaving our home and entering a new environment and stress related sicknesses may occur. Breeder does not assume any liability for any injury, or neglect to this puppy after pickup. It is the Buyers responsibility to prevent illness and injury by providing necessary booster vaccinations, veterinary care, nutrition, fresh water, shelter and supervision. The breeder has made every effort to breed healthy dogs and has raised this puppy to the best of her ability. All puppies carry large parasites such as round worms, pin worms, hook worms and said puppy has been treated against all these parasites. Buyer understands that de-wormers are not effective against the eggs of said large parasites and so buyer must continue to have puppies wormed as recommended by their veterinarian until the puppy is near to adulthood. All puppies can carry micro parasites such as coccidian, giardia and other harmless yet annoying micro parasites. All of our puppies have been treated for such micro parasites if the needed it which is determined by our vets. It still may be necessary for new puppy buyer to treat said puppy again at some point before puppy reaches adulthood and this is very normal. If your puppy gets diarrhea 4 to 5 days after getting his next vaccination make sure your vet checks his stools for micro parasites. Although we always take our dogs back whether they are 2 months or 15 years old we do not give refunds!
This puppy contract/sales agreement is valid only for the original buyer and puppy and is not transferable. If puppy changes ownership this agreement is null and void.
Any legal disputes shall be heard in the county in which the seller resides. (Stanislaus County, California.)
Sellers cannot guarantee the size, color, or marking of the dog as it reaches maturity. We raise puppies to be pets. There is no guarantee either expressed or implied as to their suitability for breeding or showing.
